We hope these policies are helpful and instructional as we work together to create beautiful photographs for your marketing.<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n\n<h5 class=\"p2\"><span class=\"s1\"><b><i>Limited Licensing Release<\/i><\/b><i>:<span class=\"Apple-converted-space\">\u00a0<\/span><\/i><\/span><\/h5>\n<p class=\"p2\"><span class=\"s1\">In order to provide you with the best service and support at reasonable pricing, we do not sell our photographs. We license their use. So, the fee quoted is especially dependent on (1) payment of the invoice in full, (2) using the photographs only as indicated, and (3) protecting them with proper copyright notification.<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n\n<h4 class=\"p3\"><span class=\"s1\"><b><i>THIS SERVICE AGREEMENT IS A LIMITED LICENSE PHOTO RELEASE.<\/i><\/b><\/span><span class=\"s2\"><b><i><br \/>\n<\/i><\/b><\/span><span class=\"s3\"><\/span><\/h4>\n<p class=\"p3\"><span class=\"s3\">Images delivered are licensed to the \u201clicensee\u201d for:<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">The purpose of listing a property only.<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n\n<ul class=\"ul1\">\n \t<li class=\"li2\"><span class=\"s4\"><\/span><span class=\"s1\">Term of the listing, not to exceed 1 year. <\/span><span class=\"s6\"><br \/>\n<\/span><\/li>\n \t<li class=\"li2\"><span class=\"s4\"><\/span><span class=\"s1\">A primary photo can be used for a longer duration and for additional <\/span><span class=\"s6\"><br \/>\n<\/span><span class=\"s1\">\u201csold\u201d marketing materials. <\/span><span class=\"s6\"><br \/>\n<\/span><\/li>\n \t<li class=\"li2\"><span class=\"s4\"><\/span><span class=\"s1\">Only the \u201clicensee\u201d has permission to use the delivered images on any <\/span><span class=\"s6\"><br \/>\n<\/span><span class=\"s1\">electronic or printed form of advertisement for the promotion of <\/span><span class=\"s6\"><br \/>\n<\/span><span class=\"s1\">the property. <\/span><span class=\"s6\"><br \/>\n<\/span><\/li>\n \t<li class=\"li2\"><span class=\"s4\"><\/span><span class=\"s1\">Builders, stagers, designers, or \u201cthird parties\u201d that wish to use images <\/span><span class=\"s6\"><br \/>\n<\/span><span class=\"s1\">must contact the photographer directly for licensing and fees. In addition to payment, a property release must be obtained from the homeowner by that third party. <\/span><span class=\"s6\"><br \/>\n<\/span><\/li>\n \t<li class=\"li2\"><span class=\"s4\"><\/span><span class=\"s1\">For image integrity, and quality control we ask that images not be altered once delivered. <\/span><span class=\"s6\"><br \/>\n<\/span><span class=\"s1\"><b><\/b><\/span><\/li>\n<\/ul>\n<p><span class=\"s1\"><b>Image editing will be done by Premier Photography, fees may apply. <\/b><\/span><span class=\"s6\"><br \/>\n<\/span><\/p>\n\n<ul class=\"ul1\">\n \t<li class=\"li2\"><span class=\"s4\"><\/span><span class=\"s1\">Please contact us for an additional release for any\/all printed publications. Fees may apply. <\/span><span class=\"s6\"><br \/>\n<\/span><\/li>\n \t<li class=\"li2\"><span class=\"s4\"><\/span><span class=\"s1\">Images cannot\/will not be made available to another agent who takes over an expired or withdrawn listing. <\/span><span class=\"s6\"><br \/>\n<\/span><\/li>\n \t<li class=\"li2\"><span class=\"s4\"><\/span><span class=\"s1\">Unauthorized use of images is a copyright violation according to Copyright Act 17 U.S.C \u00a7 106, and will result in termination of this contract. <\/span><span class=\"s6\"><br \/>\n<\/span><\/li>\n \t<li class=\"li2\"><span class=\"s4\"><\/span><span class=\"s1\">Virtual tours will remain active as long as you require. Not to exceed 1 year, terms of which will be the same as above. <\/span><span class=\"s6\"><br \/>\n<\/span><span class=\"s7\"><i><\/i><\/span><\/li>\n<\/ul>\n<p><strong><span class=\"s7\"><i>COPYRIGHT NOTICE: <\/i><\/span><\/strong><span class=\"s6\"><br \/>\n<\/span><\/p>\n\n<ul class=\"ul1\">\n \t<li class=\"li2\"><span class=\"s4\"><\/span><span class=\"s1\">The photographer who has taken an image is the copyright holder of the image. Premier Photography retains all copyrights expressed and implied otherwise for all images taken. <\/span><span class=\"s6\"><br \/>\n<\/span><\/li>\n \t<li class=\"li2\"><span class=\"s4\"><\/span><span class=\"s1\">Copyright is not and will not be transferred to any other party. <\/span><span class=\"s6\"><br \/>\n<\/span><\/li>\n \t<li class=\"li2\"><span class=\"s4\"><\/span><span class=\"s1\">Licensing may be obtained for various applications of images. Please <\/span><span class=\"s6\"><br \/>\n<\/span><span class=\"s1\">contact us for more details. <\/span><span class=\"s6\"><br \/>\n<\/span><span class=\"s7\"><i><\/i><\/span><\/li>\n<\/ul>\n<p><strong><span class=\"s7\"><i>HOMEOWNER POLICY: <\/i><\/span><\/strong><span class=\"s6\"><br \/>\n<\/span><\/p>\n\n<ul class=\"ul1\">\n \t<li class=\"li2\"><span class=\"s4\"><\/span><span class=\"s1\">Home sellers\/buyers may request a copy of the photos from the photographer only. <\/span><span class=\"s6\"><br \/>\n<\/span><\/li>\n \t<li class=\"li2\"><span class=\"s4\"><\/span><span class=\"s1\">We will supply images to the homeowner in an \"owner media kit\". Fees and licenses will apply. Call for details. <\/span><span class=\"s6\"><br \/>\n<\/span><span class=\"s7\"><i><\/i><\/span><\/li>\n<\/ul>\n<p><strong><span class=\"s7\"><i>SHOOT REQUESTS:<\/i><\/span><\/strong><span class=\"s7\"><i> <\/i><\/span><span class=\"s6\"><br \/>\n<\/span><span class=\"s1\"><i>To ensure the best results of the photo shoot please be sure the home is ready prior to the scheduled shoot time. We have provided a \u201cget your home ready for photos\u201d check list available to all agents\/home owners as a guideline on our website. We work on a set time schedule for every shoot. Time is a precious commodity, both yours and ours. <\/i><\/span><span class=\"s6\"><br \/>\n<\/span><\/p>\n\n<ul class=\"ul1\">\n \t<li class=\"li2\"><span class=\"s4\"><\/span><span class=\"s1\">It is the agent\u2019s responsibility to ensure that the listing is ready for the virtual tour to be produced at the arranged time. <\/span><span class=\"s6\"><br \/>\n<\/span><\/li>\n \t<li class=\"li2\"><span class=\"s4\"><\/span><span class=\"s1\">For liability Elevate Media Productions does not handle any cleaning, dusting, or moving of furniture. <\/span><span class=\"s6\"><br \/>\n<\/span><\/li>\n \t<li class=\"li2\"><span class=\"s4\"><\/span><span class=\"s1\">The homeowner and\/or agents shall ensure that there are no hazards to the photographer\u2019s safety. <\/span><span class=\"s6\"><br \/>\n<\/span><\/li>\n \t<li class=\"li2\"><span class=\"s4\"><\/span><span class=\"s1\">The photographer will work with agents and\/or homeowners with regard to pets, but the photographer is not a pet wrangler. If <\/span>pets will be an issue, please make a note of it when you order<span class=\"Apple-converted-space\">\u00a0<\/span><span class=\"s1\">services.<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><span class=\"s4\"><\/span><\/li>\n \t<li class=\"li2\"><span class=\"s1\">Generally, we will be photographing through the entire home. We do <\/span><span class=\"s6\"><br \/>\n<\/span><span class=\"s1\">not usually include utility rooms, closets, or garages, but if you would like those included, please let us know prior to the shoot. <\/span><span class=\"s6\"><br \/>\n<\/span><span class=\"s4\"><\/span><\/li>\n \t<li class=\"li2\"><span class=\"s1\">Amenities are not included on\/in a property shoot, and fall under separate pricing and licensing. If you are requiring amenities to be photographed, please contact us prior to the shoot for additional information. <\/span><span class=\"s6\"><br \/>\n<\/span><span class=\"s7\"><i><\/i><\/span><\/li>\n<\/ul>\n<ul class=\"ul1\"><\/ul>\n<p><strong><span class=\"s7\"><i>CANCELLATION\/POSTPONEMENT POLICY: <\/i><\/span><\/strong><span class=\"s6\"><br \/>\n<\/span><span class=\"s1\"><i>Premier Photography understands that homes may not be ready for shooting as expected. <\/i><\/span><span class=\"s6\"><br \/>\n<\/span><\/p>\n\n<ul class=\"ul1\">\n \t<li class=\"li2\"><span class=\"s4\"><\/span><span class=\"s1\">It is the responsibility of the agent to inform us as soon as possible for rescheduling. <\/span><span class=\"s6\"><br \/>\n<\/span><\/li>\n \t<li class=\"li2\"><span class=\"s4\"><\/span><span class=\"s1\">A photo session that is rescheduled or canceled after 8pm the day before will be charged a 50% rescheduling fee. Premier Photography retains the right to determine situations that may be exempt. <\/span><span class=\"s6\"><br \/>\n<\/span><\/li>\n \t<li class=\"li2\"><span class=\"s4\"><\/span><span class=\"s1\">Once a photographer has arrived at a property, the order may be canceled, however there will be no refund.<\/span><\/li>\n \t<li class=\"li2\">Reschedules will be subject to the photographer\u2019s availability.<\/li>\n<\/ul>\n<p><strong><span class=\"s7\"><i>WEATHER POLICY: <\/i><\/span><\/strong><span class=\"s6\"><br \/>\n<\/span><\/p>\n\n<ul class=\"ul1\">\n \t<li class=\"li2\"><span class=\"s4\"><\/span><span class=\"s1\">There will be times services cannot be completed due to weather. In those circumstances, the decision about shooting is up to the agent. If the agent chooses to proceed with photography, we will provide the best images we can. If additional outdoor photos are required on a better weather day, our standard re- shoot fee will apply.<\/span><\/li>\n \t<li class=\"li2\">No reschedule fee will be charged in the event of bad weather. Reschedules will be subject to availability.<\/li>\n<\/ul>\n<p><strong><span class=\"s7\"><i>PAYMENT POLICY: <\/i><\/span><\/strong><span class=\"s6\"><br \/>\n<\/span><\/p>\n\n<ul class=\"ul1\">\n \t<li class=\"li2\"><span class=\"s4\"><\/span><span class=\"s1\">Payments will be received upon delivery of images. <\/span><span class=\"s6\"><br \/>\n<\/span><\/li>\n \t<li class=\"li2\"><span class=\"s4\"><\/span><span class=\"s1\">Credit card payments can be processed via Tonomo when the image <\/span><span class=\"s1\">delivery email is sent.<\/span><\/li>\n \t<li class=\"li2\"><span class=\"s1\">The photo release is not authorized until payment is received in full. <\/span><span class=\"s6\"><br \/>\n<\/span><span class=\"s4\"><\/span><\/li>\n \t<li class=\"li2\"><span class=\"s3\">Failure to pay for the images will result in a copyright infringement. <\/span><span class=\"s6\"><br \/>\n<\/span><span class=\"s3\">You will be asked to remove the image from any electronic or printed form of advertisement. Failure to stop using them will result in legal action. <\/span><span class=\"s6\"><br \/>\n<\/span><span class=\"s3\"><b><\/b><\/span><\/li>\n<\/ul>\n<p><span class=\"s3\"><b>Thank you for taking the time to read our terms and agreement.
